Carefully review these Terms of Use (“Terms”), constituting a formal agreement between the user (“you”) and Ann Lin Photography LTD, which dictates the terms under which you may utilize the Products (further described below) acquired via the website at annlin.photo or any associated domains or subdomains (the “Website”). The terms “you”, “client”, and “your” refer each individual interacting with this website, and “we”, “us”, and “our” represent Ann Lin Photography LTD.

The “Products” encompassed by these Terms span images, templates, communications, workshops, and other materials offered for sale or upon which you divulge personal details in exchange, including gratis downloadable content or other information accessible via the Website, provided by Ann Lin Photography LTD. These Products are Ann Lin Photography LTD’s intellectual property and are under our ownership.

Your purchase of any Product signifies your consent to these Terms and foregoes any other stipulations or assertions. Should these Terms become unacceptable to you at any point, or if you disagree with them, cease all use of Ann Lin Photography LTD’s services forthwith.

By utilizing the Website or any Products, services, or applications from which you derive benefit, either via payment or otherwise, you affirm that you have reached the legal age of 18 and are otherwise fully capable of entering into a legally binding contract.

INTELLECTUAL PROPERTY LICENSE

Ann Lin Photography LTD is the rightful owner of all intellectual property contained on the Website, including but not limited to text, logos, images, headers, trademarks, service marks, design elements, and any other proprietary components (save for those we have licensed from third parties). This includes (a) all Products and parts thereof; (b) all materials provided to you as part of Ann Lin Photography LTD’s services; and © any additional intellectual property rights awarded to Ann Lin Photography LTD, be it via state or federal registration or as recognized by common law (“Intellectual Property”). Other than as explicitly mentioned herein, no rights to any Intellectual Property within the Products or otherwise accessible via the Website are conferred to you.

It is your responsibility not to infringe on Ann Lin Photography LTD’s Intellectual Property rights unlawfully. Any infringement may prompt us to undertake necessary legal action to safeguard our Intellectual Property. You are advised to manage your use of the Products, along with any other downloaded materials or services, to ensure compliance with these Terms.

In accordance with these Terms of Use, as long as you remain compliant, Ann Lin Photography LTD grants you a non-exclusive, non-transferrable license to download, view, copy, and print the Digital Products you buy exclusively for personal or business use concerning your photography clients or similar professional activities, excluding reproduction, copying, or any alternate use of the Products or gratis downloadable content for resale or distribution (“Permitted Use”), subject to the conditions that you:

1. Respect all copyright protections ascribed to the Products, whether formally registered or as per common law.

2. Honor all trademark protections related to the Products, whether formally registered or as per common law.

3. Do not use the Products or otherwise offer them on any other website, through a networked computer environment, or otherwise offer them for distribution or sale or in any manner inconsistent with Permitted Use as provided by these Terms; and.

4. Do not modify the Products in any way beyond edits consistent with Permitted Use provided by these Terms. Such permission to modify Products consistent with Permitted Use in no way expands the limited license provided herein, nor does grant you intellectual property ownership in, or provide a general right to modification of, the Products.

Remember, it is your duty to download the Product promptly and to secure all purchases. Ann Lin Photography LTD bears no responsibility for any loss or damage to Products post-download or for any unintended downloads made by customers, and no reimbursement will be issued for such downloads. Upon request, Ann Lin Photography LTD will reissue a 24-hour access link to purchased products if you happen to misplace the original download link.

By inputting your personal details on the Website, you authorize Ann Lin Photography LTD to contact you through email, phone, or any other means you provide, to inform you about promotions, new Products, or policy updates. Should you prefer not to receive emails, please inform us at annlinphoto19@gmail.com, and we will cease such communications.

RETURN/REFUND POLICY

You understand and agree that all purchased Products and materials are non-refundable and not eligible for return under any circumstances. All transactions are conclusively deemed final.

PUNCTUALITY + ATTENDANCE

Clients are expected to arrive punctually and prepared for their photoshoots.

Adherence to scheduled times is essential for the seamless progression of each session. Sessions will not be extended due to lateness. A leniency period of up to 15 minutes may be granted. Beyond this timeframe, clients will incur a late fee based on a rate of $150/hour. Should the client be delayed by more than 30 minutes, the session will be deemed cancelled, and the client will forfeit the session fee.

CANCELLATIONS/RESCHEDULING

Should rescheduling be necessary due to unforeseen circumstances such as adverse weather conditions, health issues, or personal/family emergencies, an attempt will be made to set a new session date at the earliest convenience. If a new date isn’t arranged within 3 months from the original purchase date, the Client’s session fee will be forfeited. In the unlikely event that Ann Lin Photography LTD is unable to conduct the required Work on the session/event day due to health concerns, personal or family emergencies, a complete refund of the session fee will be processed for the Client within 5 business days of the scheduled event. The Client agrees to hold Ann Lin Photography LTD harmless for any losses, damages, or liabilities.

PRINTS & PRODUCTS

Clients can expect to receive a digital gallery of edited images within 2 weeks following the session date. Note that galleries will be accessible for 14 days post-delivery before expiring automatically.

NO WARRANTIES

The PRODUCTS are provided on an “AS IS” basis. Ann Lin Photography LTD disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose concerning any forms, templates, information accuracy, or any rights or licenses outlined in this Agreement.

Acquisition of materials made available through the Website is at your discretion and risk. Ann Lin Photography LTD does not guarantee the Site’s, Products', or Materials' precision and reliability in every circumstance.

LIMITATION OF LIABILITY AND INDEMNIFICATION

To the fullest extent permitted by law, Ann Lin Photography LTD shall not be liable to you or to any other person or entity or any third party for any any general, indirect, punitive, special, incidental, consequential, or exemplary damages, or any loss of profits, or any other damages or revenues, whether incurred directly or indirectly, or costs or losses arising out of your use of the website, materials or products, including attorney’s fees and related expenses of litigation and arbitration, or any loss of data, use, or other intangible losses, resulting from your access to or use of or inability to access or use the Products.

The extent of Ann Lin Photography LTD’s liability to you shall be limited to the total amount you paid Ann Lin Photography LTD for the Products, services, and Materials, should there be any liability found on the part of Ann Lin Photography LTD.
